Public Notice - NOTICE OF ADOPTION OF CHANGES TO RULES AND REGULATIONS OF FRANKLIN COUNTY \WATER DISTRICT - 01/09/2020

Pursuant to Section 51.129 of the Texas Water Code, notice is hereby given that on the 15th day of October 2018, the Board of Directors of Franklin County Water District

(the “District”) adopted amendments to the Rules and Regulations of Franklin County Water District (“Rules”), which contain provisions relating to: (a) addition of a definition of a setback; (b) regulation of flags and signs; (c) private pool fencing; and, (d) clarification on variances.  In particular, the Rules also provide the following:

The “Definitions” section adds the definition for “Setback”, which means the distance from a curb, property line, or structure within which any building is prohibited.

Article 13 adds limitations to the height of flags or signs to a height of twenty-five feet.

Article 15 removes the requirement for safety fencing on private swimming pools.

Article 16 clarifies that variances may be granted if such variance would not adversely affect surrounding property or any facilities owned or maintained by the District.

Pursuant to Texas Water Code § 51.128, the Rules shall be recognized by the courts as if they are penal ordinances of a city, and any breach of the Rules may subject the violator to a penalty.

This notice is a summary statement of the District’s Rules and does not contain all of the specific provisions and requirements established by the Rules.  A copy of the Rules is on file in the office of the District, 112 N Houston Street, Mount Vernon, Texas 75457 where it may be read by any interested person.
